Times of India Violating Copyright

Sep 7th, 2008 | By A Ash | Category: Complaints

The below complaint is a repost of the complaint posted at http://www.flickr.com/photos/twilightfairy/2720464496 with permission to repost here.

One of my pictures got “flicked” from Flickr and got published in a supplement of TOI’s called, “what’s hot”, dated 18th July’08. I happened to take a look at this supplement very much by chance. I have no idea, how many such images are being used on a daily basis - they could be anyones.

On contacting the editor, I was told that it is common practice to “use” free images from the net! Plagiarism in its full glory. They actually went ahead and used an image with “all rights reserved” clearly mentioned on my page. Nowhere does it say that this image is free to use. Original picture here - www.flickr.com/photos/twilightfairy/622839565/

Since the time I have asked for compensation I have not received any response from them.

Updates to this issue is available at http://blog.twilightfairy.in/2008/09/01/toi-believes-flickr-is-for-flicking/

  4. Hi Ash,
It is a common practice to use contents published in net or any other media. Copyright infringement in case of freely published content occurs only when the person who uses content belonging to some other person and publishes the same either by hiding the identity of the owner of the content or if he publishes the same by fake identity or passes it as his own. In such a case legal action can definitely be taken against the person who infringes the copy right.
